1. Acceptance of Terms

By accessing or using Scanlix, you agree to be bound by these Terms of Service. If you do not agree, do not use our service.

2. Description of Service

Scanlix provides a WordPress accessibility scanning plugin and cloud API. The service crawls your website, detects WCAG accessibility issues, and offers AI-powered fix suggestions. You may use the plugin, dashboard, and API according to your plan tier.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and notify us of any unauthorized use.

4. Plan Tiers & Billing

Scanlix offers Free, Lite, Starter, Pro, Business, and Enterprise plans. Plan details and pricing are available on our pricing page. Payments are processed by Stripe. You authorise us to charge your payment method according to your selected plan and billing cycle.

5. Cancellation

You may cancel your subscription at any time from your billing dashboard. Upon cancellation, you retain access until the end of your current billing period. No further charges will be made.

6. Refund Policy

Refunds are at Akaya Ltd's discretion and may be granted within 14 days of purchase. Refunds are processed via Stripe to your original payment method. Upon refund, your account is downgraded to the Free plan. See our Refund Policy for full details.

7. Acceptable Use

You agree not to:

  • Abuse, overload, or attempt to circumvent service limits
  • Use the service for scraping, reverse engineering, or unauthorized access
  • Violate any applicable laws or third-party rights

You warrant that you own or have written authority to scan every URL you submit to Scanlix. You are solely responsible for ensuring you have the legal right to scan any website you add to the service.

8. Intellectual Property

Akaya Ltd (trading as Scanlix) owns all rights to the platform, software, and branding.You retain ownership of your content and data. By using Scanlix, you grant us a limited licence to process your data as necessary to provide the service.

8A. No Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCANLIX IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

Akaya Ltd specifically disclaims all implied warranties including but not limited to:

  • MERCHANTABILITY: We do not warrant that the service is suitable for commercial use or free from defects
  • FITNESS FOR A PARTICULAR PURPOSE: We do not warrant that Scanlix will meet your specific accessibility compliance needs or business requirements
  • NON-INFRINGEMENT: We do not warrant that AI-generated fixes do not infringe third-party intellectual property rights
  • ACCURACY: We do not warrant that scan results, fix suggestions, compliance scores, or WCAG criterion mappings are error-free, complete, or current
  • COMPATIBILITY: We do not warrant compatibility with all WordPress themes, plugins, hosting environments, page builders, or custom code
  • DATA INTEGRITY: We do not warrant that applying fixes will not cause data loss, site downtime, functionality breakage, or conflicts with existing code
  • SECURITY: We do not warrant that the service is free from viruses, malware, or security vulnerabilities
  • AVAILABILITY: We do not warrant uninterrupted, timely, secure, or error-free operation of the service

You expressly acknowledge and agree that:

  • AI-generated fixes are suggestions that may be incorrect, incomplete, or cause unintended consequences
  • You must test all fixes on a staging environment before production deployment
  • The one-click rollback feature may not always restore your site to its exact previous state
  • Scanlix assists with WCAG compliance but does not guarantee legal immunity from ADA, Section 508, or accessibility-related lawsuits
  • You remain solely responsible for ensuring your website's compliance with all applicable accessibility laws and regulations
  • You use Scanlix entirely at your own risk and discretion
  • Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you

9. Limitation of Liability

Important: Scanlix assists with accessibility compliance but does NOT guarantee legal immunity from ADA, Section 508, or other accessibility-related lawsuits. Compliance with accessibility laws remains your responsibility. We provide the software "as is" and disclaim warranties to the fullest extent permitted by law.

10. Service Availability

We strive for high availability but do not guarantee uptime for non-Enterprise plans. Enterprise customers may have SLAs defined in their individual contracts.

10A. Limitation of Liability — Cap

To the fullest extent permitted by applicable law, Akaya Ltd's total aggregate liability to you arising out of or in connection with these Terms, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the greater of: (a) the total fees paid by you to Akaya Ltd in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred pounds sterling (£100). Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10B. Termination and Suspension

Akaya Ltd reserves the right to suspend or terminate your access to the Service at any time if you materially breach these Terms, with immediate effect for serious breaches and with 7 days' written notice for other breaches. Upon termination, your data will be handled in accordance with our Privacy Policy. If Akaya Ltd terminates your account other than for breach, any prepaid fees for the unused portion of your current billing period will be refunded to you.

11. Modification of Terms

We may modify these terms with at least 30 days' notice via email to your registered address. Continued use after the notice period constitutes acceptance of the new terms.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Enterprise Override

Enterprise customers with individual contracts: the terms of your contract supersede these general Terms of Service where they conflict.
